Isaiah Haastrup - a "Charlie Gard" Legal Battle

As might have been expected, commentators are now using "Charlie Gard" as an adjective to describe medical futility conflicts between parents and clinicians. One of the latest such cases involves 8-month-old Isaiah Haastrup.

Isaiah was both in February with severe brain injury from lack of oxygen. King's College Hospital clinicians say that treatment is "futile, burdensome and not in his best interests."  Isaiah's parents do not agree. The court will hear from independent experts in January 2018.

On October 13, 2017, the Harris County District Court dismissed a constitutional due process challenge to the Texas Advance Directives Act.  This week, the plaintiffs appealed that Order to the Court of Appeals in Houston.

Annual Pellegrino Seminar - Philosophy of Medicine Paper Award

The annual Pellegrino Seminar to be held at Georgetown University on March 2, 2018 will focus on his philosophy of medicine. 

Georgetown plans to offer a competition for the best paper from an early-career scholar. The winner will be rewarded with an opportunity to present their paper at this national meeting, as well as transportation, hotel, and a cash award. Essays should be submitted by January 12, 2018. 

Medical Futility Jury Trial Begins against Hospital that Stopped Life Support without Consent

It is rare for any medical malpractice case to reach a jury. Most are settled or dismissed at earlier stages of litigation.  It is even rarer for a medical futility case to reach a jury. But that is happening this month in Milford, Connecticut (Marsala v. Yale-New Haven Hospital, No. AAN-CV12-6010861-S).

Judging by the pretrial motions in limine (to keep evidence from the jury), this could be very interesting.

Patients with advanced illnesses sometimes request that physicians help hasten their death. Increasingly in North America and Europe, legal options allow physicians to perform this role. Among death-hastening options, the spotlight has been on physician-assisted death. However, voluntarily stopping eating and drinking (VSED) is also a course that patients may choose. 

Although VSED theoretically does not require physician involvement, clinician participation is critical in terms of initial assessment and ongoing management. In this review, we examine both clinical issues in assessing patients who are considering VSED and the clinical challenges that may emerge during VSED. We also explore some of the underlying ethical and legal considerations for physicians who either care for or decline to care for these patients. Physicians who care for seriously ill patients should be prepared to respond to patients� requests to participate in VSED.

Defining Hope - Film Explore Weighing End of Life Options

A new film released in November 2017, "Defining Hope" explores eight patients with life-threatening diseases and the nurses that guide them through their journey. WBEZ Chicago reviews the film here

"Defining Hope" is a story about people weighing what matters most at the most fragile junctures in life, and the nurses who guide them. It�s a documentary that follows patients with life-threatening illness as they make choices about how they want to live, how much medical technology they can accept, what they hope for and how that hope evolves when life is threatened. It is optimistic and reminds us that we have choices in how we die.

New Constitutional Court Attack on Brain Death

Humber River Hospital (Toronto)

Shalom Ouanounou was declared dead in late September. But his family is asking a Toronto court for an injunction to keep him on a ventilator and feeding tube while it pushes to have his death certificate revoked.

Ouanounou's family challenge the Canadian guidelines on brain death, because they do not accommodate religious beliefs like Orthodox Judaism that consider death to be complete cardiac and respiratory failure. The family argues that disregarding those beliefs is a serious assault on Ouanounou's human dignity and religious liberty.

Similar claims were made in the Israel Stinson case. That case is now on appeal in the US Court of Appeals for the Ninth Circuit (No. 17-17153).
